⚠️ IMPORTANT — READ THIS DISCLAIMER CAREFULLY BEFORE USING HELLO FAY'S PRODUCT. BY PURCHASING OR USING THE PRODUCT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND ACCEPT ALL OF THE TERMS AND WARNINGS BELOW.
1. NO MEDICAL CLAIMS — COSMETIC PRODUCT
Hello Fay is a chemical depilatory cream sold by Noire Eagle LLC. It is intended only as a cosmetic product for the temporary removal of unwanted body hair.
The product:
a) Has not been evaluated or approved by the U.S. Food and Drug Administration (FDA) for the diagnosis, treatment, prevention, or cure of any medical condition or disease;
b) Is not a drug, medication, medical device, or therapeutic product;
c) Is not intended to address, treat, mitigate, or alter any underlying skin condition, hair growth disorder, hormonal imbalance, or other medical issue;
d) Is intended solely for cosmetic use as directed on the product packaging.
Any statements made on the Site, in marketing materials, or in customer testimonials regarding the appearance, smoothness, or hair removal effects of the product describe a cosmetic outcome only, not a medical, therapeutic, or curative effect.
2. NO MEDICAL ADVICE
The information provided on the Site, in product packaging, in emails, and in any communications from Hello Fay is for general informational purposes only. It is not intended as, and should not be construed as, medical advice, diagnosis, treatment, or dermatological consultation.
You should always consult a qualified healthcare professional, dermatologist, or licensed physician before using the product if you:
a) Have any skin condition, including but not limited to eczema, psoriasis, dermatitis, rosacea, vitiligo, or active acne;
b) Have a history of allergic reactions to cosmetic products, fragrances, or chemical depilatories;
c) Are pregnant, planning to become pregnant, or nursing;
d) Are taking any medication, including but not limited to retinoids, corticosteroids, blood thinners, immunosuppressants, or hormonal treatments;
e) Have recently undergone any cosmetic procedure (chemical peel, laser treatment, waxing) or sun exposure;
f) Have sensitive skin, broken skin, sunburn, irritation, cuts, abrasions, moles, warts, or any skin abnormality in the intended area of use;
g) Are under 18 years of age.
3. PATCH TEST REQUIRED — CHEMICAL DEPILATORY WARNING
Hello Fay contains active chemical ingredients that dissolve the protein structure of hair. These ingredients can cause skin irritation, chemical burns, or allergic reactions in some individuals.
YOU ARE REQUIRED TO PERFORM A PATCH TEST AT LEAST 24 HOURS BEFORE FULL APPLICATION:
a) Apply a small amount of product to a discreet area of skin (typically the inner arm or behind the knee);
b) Leave the product on for no longer than the time stated on the packaging;
c) Rinse thoroughly with cool water;
d) Wait 24 hours and observe the area for any reaction;
e) If you experience burning, severe itching, redness, blistering, swelling, hives, or any other adverse reaction, DO NOT USE the product on a larger area and discontinue use immediately;
f) If a reaction occurs during the patch test, you waive your right to apply the product more broadly and assume full responsibility for any consequences of doing so.
FAILURE TO PERFORM THE PATCH TEST AS INSTRUCTED CONSTITUTES MISUSE OF THE PRODUCT AND RELEASES HELLO FAY FROM ALL LIABILITY FOR ANY RESULTING SKIN REACTION OR INJURY.
4. CONTRAINDICATIONS — DO NOT USE
Do not use Hello Fay on:
a) The face, lips, eyebrows, or any area near the eyes, nose, mouth, or ears;
b) The genital, anal, or perianal area, or inside any body cavity;
c) Nipples or breast tissue;
d) Broken, cut, irritated, sunburned, blistered, or otherwise damaged skin;
e) Areas affected by moles, warts, varicose veins, scar tissue, or skin growths;
f) Skin that has been exposed to direct sunlight, swimming pool chlorine, or other harsh chemicals within the previous 24 hours;
g) Skin that has been treated with retinoids, exfoliants, chemical peels, or laser hair removal within the previous 7 days;
h) Children under 18 years of age.
Do not use Hello Fay:
a) More frequently than the package instructions allow (typically not more than once every 72 hours);
b) For longer than the maximum application time stated on the packaging;
c) In conjunction with other hair removal products, depilatory creams, or skin treatments;
d) If you are pregnant, nursing, or have a known sensitivity to chemical depilatories.
5. INDIVIDUAL RESULTS WILL VARY
Hair removal results vary significantly between individuals based on hair type, hair density, skin type, hormonal factors, and frequency of use. Hello Fay makes no guarantee, express or implied, regarding:
a) The completeness of hair removal;
b) The duration of hair removal results;
c) The smoothness or appearance of the skin after use;
d) Any reduction in hair regrowth over time.
Customer testimonials, before/after photos, and influencer content reflect individual experiences and are not representative of typical or expected results.
6. ADVERSE REACTIONS — WHAT TO DO
If you experience any adverse reaction during or after using Hello Fay:
a) Discontinue use immediately;
b) Rinse the affected area thoroughly with cool (not hot) water;
c) Do not apply any other cosmetic product to the area;
d) For mild irritation, allow the skin to rest and recover before any further cosmetic treatment;
e) FOR SEVERE REACTIONS — including blistering, intense burning, swelling, persistent rash, difficulty breathing, or signs of allergic reaction — SEEK IMMEDIATE MEDICAL ATTENTION. CALL 911 OR YOUR LOCAL EMERGENCY SERVICES IF THE REACTION IS SEVERE OR LIFE-THREATENING.
After seeking any necessary medical care, you may report the reaction to us at support@hellofay.com within 7 days, providing your order number, a description of the reaction, photographs (if possible), and details of any medical attention sought. Pursuant to the Modernization of Cosmetics Regulation Act (MoCRA), we maintain records of reported adverse events and report serious adverse events to the FDA as required by applicable law.
Reporting an adverse event to Hello Fay does not constitute admission of liability and does not waive any of the limitations of liability set forth in our Terms of Service.
7. ASSUMPTION OF RISK
BY PURCHASING AND USING HELLO FAY'S PRODUCT, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
a) Chemical depilatories carry inherent risks, including the risk of skin irritation, chemical burns, allergic reactions, and other adverse effects;
b) You have been adequately warned of these risks through this Disclaimer, the product packaging, and the patch test requirement;
c) You voluntarily assume all risks associated with the use of the product;
d) You waive any claim against Hello Fay, Noire Eagle LLC, and their respective officers, directors, employees, members, agents, affiliates, and suppliers for any injury, reaction, damage, or loss arising from:
(i) Your failure to perform the patch test as instructed;
(ii) Your use of the product contrary to the instructions or contraindications set forth in this Disclaimer or on the product packaging;
(iii) Any pre-existing skin condition, allergy, or medical condition you have not disclosed or addressed with a healthcare professional;
(iv) Any reaction that, despite proper use, falls within the inherent risks of chemical depilatory products.
8. NO PROFESSIONAL RELATIONSHIP
Your purchase or use of Hello Fay's product does not create any physician-patient, dermatologist-patient, or other professional healthcare relationship between you and Hello Fay, Noire Eagle LLC, or any of their representatives.
9. FDA DISCLAIMER
This product has not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.
The product is registered as a cosmetic under the Modernization of Cosmetics Regulation Act (MoCRA). Cosmetic products are not subject to the same pre-market approval requirements as drugs or medical devices.
10. LIMITATIONS ON THIS DISCLAIMER
Nothing in this Disclaimer is intended to:
a) Exclude or limit liability that cannot be excluded or limited under applicable law;
b) Affect any mandatory consumer protection rights you may have under the laws of your state of residence;
c) Override or modify the dispute resolution provisions set forth in our Terms of Service.
The limitations in this Disclaimer apply to the maximum extent permitted by applicable law.
