PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER (SECTION 14) THAT AFFECT YOUR LEGAL RIGHTS. BY USING THIS WEBSITE OR PURCHASING ANY PRODUCT, YOU AGREE TO RESOLVE DISPUTES THROUGH INDIVIDUAL ARBITRATION AND WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.
1. ACCEPTANCE OF TERMS
These Terms of Service ("Terms") govern your access to and use of the website https://hellofay.com ("Site") and the purchase of any products offered through the Site. The Site is operated by:

(hereinafter "Hello Fay," "we," "us," or "our").
By accessing the Site or placing an order, you ("Customer," "you," or "your") agree to be bound by these Terms, our Privacy Policy, our Return & Refund Policy, and our Disclaimer. If you do not agree, do not use the Site and do not place an order.
2. ELIGIBILITY
You must be at least 18 years of age and legally capable of entering into a binding contract under the laws of your jurisdiction to purchase products from Hello Fay. By placing an order, you represent that you meet these requirements.
3. PRODUCT INFORMATION AND ACCURACY
Hello Fay makes commercially reasonable efforts to display accurate product descriptions, images, ingredients, and pricing. However, we do not warrant that product descriptions, colors, or other content on the Site are accurate, complete, reliable, current, or error-free. Product appearance may vary slightly from images due to lighting, screen calibration, and packaging revisions.
We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time without prior notice (including after you have placed an order).
4. ORDERS AND ACCEPTANCE
Placement of an order through the Site constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion, including (but not limited to) cases of:
- Suspected fraud or unauthorized transactions;
- Inaccurate or incomplete customer information;
- Product unavailability;
- Pricing or description errors;
- Suspected violation of these Terms.
An order is not accepted until we send a shipping confirmation email. We are not obligated to fulfill orders containing pricing errors, even if payment has been processed; in such cases, we will issue a full refund.
5. PRICING AND PAYMENT
All prices are listed in U.S. Dollars (USD). Prices are subject to change without notice. Applicable sales tax (where required by law) will be calculated at checkout.
We accept the following payment methods:
- Visa, Mastercard, American Express, Discover (via Shopify Payments);
- PayPal;
- Shop Pay;
- Apple Pay;
- Google Pay.
Payment is processed at the time of order placement.
6. SHIPPING AND CUSTOMS
Products are shipped directly from our supplier's warehouse in the People's Republic of China to customers in the United States. Estimated delivery time is 10 to 21 business days from dispatch.
⚠️ Due to changes in U.S. customs regulations effective May 2, 2025, packages from China may be subject to customs duties, tariffs, and handling fees collected by the carrier at the time of delivery. These charges are imposed by U.S. Customs and Border Protection and the carrier, are the responsibility of the Customer as the importer of record, are not collected by Hello Fay, and are not refundable by Hello Fay.

7. RETURNS AND REFUNDS
Returns and refunds are governed by our Return & Refund Policy. Due to hygiene regulations applicable to personal care products, opened products are not eligible for return.
8. PRODUCT USE — PATCH TEST REQUIRED
⚠️ Hello Fay is a chemical depilatory product. Improper use may result in skin irritation, chemical burns, allergic reactions, or other adverse effects.
By purchasing or using Hello Fay's product, you expressly acknowledge and agree that:
a) You will perform a patch test on a small, discreet area of skin at least 24 hours before full application, exactly as described on the product packaging;
b) You will not use the product on broken, irritated, sunburned, or sensitive skin, on the face, near eyes, in the genital area, or in any manner contrary to the product instructions;
c) You will discontinue use immediately if any irritation, burning, or unusual reaction occurs;
d) You assume all risks associated with the use of the product, including the risk that you may be among the minority of users who experience an adverse reaction;
e) You understand that no chemical depilatory is suitable for all skin types, and that Hello Fay is not a medical product, has not been evaluated by the U.S. Food and Drug Administration for the treatment, prevention, or cure of any condition, and is not intended to diagnose, treat, cure, or prevent any disease.

9. INTELLECTUAL PROPERTY
All content on the Site — including text, graphics, logos, images, videos, product designs, packaging, and the Hello Fay brand — is the property of Noire Eagle LLC or its licensors and is protected under U.S. and international intellectual property laws.
You may not copy, reproduce, distribute, modify, transmit, display, publish, sell, license, or create derivative works from any content on the Site without our prior written consent.
10. PROHIBITED USES
You may not use the Site to:
a) Violate any applicable law, regulation, or court order;
b) Infringe upon any third party's intellectual property or other rights;
c) Submit false, misleading, or fraudulent information;
d) Engage in any activity that interferes with or disrupts the Site (including viruses, denial-of-service attacks, scraping, or automated access);
e) Resell or commercially exploit any product purchased from Hello Fay without our written consent;
f) Misrepresent your identity or impersonate any person or entity.
We reserve the right to terminate access, cancel orders, and pursue any legal remedies for violations of this Section.
11. DISCLAIMERS AND LIMITATION OF WARRANTIES
THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HELLO FAY AND NOIRE EAGLE LLC DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
a) IMPLIED WARRANTIES OF MERCHANTABILITY;
b) IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE;
c) WARRANTIES OF NON-INFRINGEMENT;
d) WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE PRODUCT WILL ACHIEVE ANY PARTICULAR RESULT, WILL BE SUITABLE FOR YOUR SKIN TYPE, OR WILL BE FREE FROM SIDE EFFECTS. INDIVIDUAL RESULTS WILL VARY.
NO ADVICE OR INFORMATION OBTAINED FROM HELLO FAY (WHETHER ORAL OR WRITTEN) CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
a) IN NO EVENT SHALL HELLO FAY, NOIRE EAGLE LLC, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, MEMBERS, AGENTS, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING (WITHOUT LIMITATION) DAMAGES FOR LOST PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, PERSONAL INJURY, EMOTIONAL DISTRESS, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES;
b) OUR AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCT — WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY — SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM;
c) THE LIMITATIONS IN THIS SECTION APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE;
d) NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE WHERE SUCH EXCLUSION IS PROHIBITED.
Some states do not allow the exclusion or limitation of certain damages, so portions of this Section may not apply to you. In such states, our liability is limited to the maximum extent permitted by law.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Hello Fay, Noire Eagle LLC, and their respective officers, directors, employees, members, agents, affiliates, and suppliers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
a) Your breach of these Terms;
b) Your misuse of the product, including failure to perform a patch test or use contrary to product instructions;
c) Your violation of any law or regulation;
d) Your violation of any third party's rights, including intellectual property rights.
14. BINDING ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH US AND LIMITS YOUR LEGAL REMEDIES.
a) AGREEMENT TO ARBITRATE. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, any product, or your relationship with Hello Fay (collectively, "Disputes") shall be resolved exclusively through final and binding individual arbitration, except as set forth below.
b) ARBITRATION RULES. Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at https://www.adr.org. The arbitration shall be conducted by a single arbitrator. The arbitrator's decision is final and binding.
c) LOCATION AND FORMAT. The arbitration shall be conducted by telephone, online, or based solely on written submissions, at the election of the party seeking relief. If an in-person hearing is required, it shall take place in Cheyenne, Wyoming, unless you and Hello Fay agree otherwise.
d) FEES. To the extent the AAA Consumer Arbitration Rules require Hello Fay to pay arbitration fees, we will do so. Each party is otherwise responsible for its own attorneys' fees, unless awarded otherwise by the arbitrator.
e) CLASS ACTION WAIVER. YOU AND HELLO FAY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, MASS ACTION, OR PRIVATE ATTORNEY GENERAL ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING. THE ARBITRATOR MAY AWARD RELIEF ONLY ON AN INDIVIDUAL BASIS.
f) JURY TRIAL WAIVER. YOU AND HELLO FAY WAIVE ANY RIGHT TO A JURY TRIAL.
g) EXCEPTIONS. Notwithstanding the foregoing, either party may bring (i) an individual claim in small claims court if the claim qualifies, or (ii) a claim for injunctive relief to protect intellectual property rights.
h) OPT-OUT RIGHT. You may opt out of this arbitration agreement by sending a written notice to support@hellofay.com within thirty (30) days of your first purchase. The notice must include your name, order number, and a statement that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms.
i) SEVERABILITY OF ARBITRATION TERMS. If the class action waiver is found to be unenforceable, then the entirety of this Section 14 shall be null and void, and the Dispute shall proceed in court in accordance with Section 15.
15. GOVERNING LAW AND JURISDICTION
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of laws principles.
Subject to the arbitration agreement in Section 14, any Dispute that is not subject to arbitration shall be brought exclusively in the state or federal courts located in Laramie County, Wyoming, and you consent to the personal jurisdiction of such courts. You waive any objection based on inconvenient forum.
This Section does not affect any mandatory consumer protection rights that may apply in your state of residence and that cannot be waived by contract.
16. NO MEDICAL ADVICE
The information on the Site is for general informational purposes only and is not intended as, and shall not be construed as, medical, dermatological, or professional health advice. You should consult a qualified healthcare professional before using the product if you have any health condition, are pregnant or nursing, are taking medication, or have skin allergies or sensitivities.
17. THIRD-PARTY LINKS
The Site may contain links to third-party websites or services. We are not responsible for the content, accuracy, privacy practices, or availability of any third-party site. Use of any such site is at your own risk.
18. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. Changes are effective when posted on the Site with an updated "Last updated" date. Your continued use of the Site after such posting constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Site.
19. SEVERABILITY
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to render it enforceable.
20. WAIVER
Our failure to enforce any provision of these Terms shall not be deemed a waiver of that or any other provision.
21. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Return & Refund Policy, Shipping Policy, and Disclaimer, constitute the entire agreement between you and Hello Fay regarding your use of the Site and supersede all prior agreements, written or oral.
